Loss of consortium is a legal term used to describe the recovery that a family member can obtain as a result of another’s personal loss. Primarily, loss of consortium claims are limited to the spouse or immediate family of those who were injured and often require a catastrophic incident or death in order to recover from the tortfeasor. For example: “A husband was driving down the road and gets t-boned in a serious accident, the husband is in the hospital for multiple months, leaving the wife to have to alter her life in order to take care of her husband as well as household and fiscal responsibilities that they had once shared“.
